Compulsory Purchase Order for Medway Crossing at Peters Pit, Wouldham

Further to Minute CB 10/093 the report updated the position on the project having regard to the actions of Medway Council and further advice received from Queen's Counsel. It was noted that the recommendation to make a compulsory purchase order remained unchanged from the October meeting as the same compelling case in the public interest existed. One small change was required in the process in that the decision to make the CPO rested with Cabinet rather than the Council.

The Cabinet resolved that a compulsory purchase order be made under section 226 of the Town and Country Planning Act 1990.

Reasons: As set out in the joint report of the Legal Services Partnership Manager and Director of Planning, Transport and Leisure.
